The Delhi High Court on Tuesday stayed Arvind Kejriwal's bail order passed by the trial court, saying the trial court should have at least recorded its satisfaction with compliance with the two conditions of the article 45 of the Prevention of Money Laundering Act (PMLA) before passing it. the impugned order.

The bench of Justice Sudhir Kumar Jain stated in the order: "The Court has to maintain a balance between a judgment of acquittal and conviction and an order granting bail well before the commencement of the trial. The Court is not supposed to weigh the evidence meticulously. However, the vacation judge in the impugned order has not discussed the requirement of section 45 of the PMLA while passing the impugned order. The trial court should have at least recorded his satisfaction with the compliance with the. twin conditions of section 45 of the PMLA before passing the impugned order."

"The perusal of the impugned order reflects that the vacation judge passed the impugned order without reviewing and appreciating all the material submitted by the rival parties, reflecting the perversity of the impugned order," observed Delhi HC while addressing the arguments raised by The counsel for the Department of Education, stating that the impugned order passed by the trial judge has observed that it is not possible to review thousands of pages of documents submitted by the respective parties, but the court has to work on the matter under consideration and approved the order according to the law.

On June 20, the trial judge granted bail to Kejriwal in the money laundering case. The next day, the ED filed an urgent petition in the High Court challenging the bail order.
