New Delhi: The BJP on Wednesday hailed the Supreme Court verdict that a divorced Muslim woman has the right to seek maintenance from her husband, saying the judgment has put an end to a threat posed to the Constitution by the decision of a previous Congress government.

BJP spokesperson and Rajya Sabha MP Sudhanshu Trivedi said the Rajiv Gandhi government's decision to bring a law to quash a high court judgment granting maintenance to divorced Muslim women was one of the biggest threats to the Constitution. , since it gave primacy to Sharia, the Islamic laws.

"Whenever the Congress was in power, the Constitution was under threat. It was a decision (by Rajiv Gandhi's government) that gave primacy to Sharia over the Constitution. The Supreme Court has now granted a big relief to Muslim women, Trivedi said, adding that it should be seen beyond a question of religion as it is a question of equal rights.

The Muslim Women (Protection of Rights on Divorce) Act, 1986 will not prevail over secular law, a bench of Justices B V Nagarathna and Augustine George Masih said, while underlining that maintenance is not charity but a right of all married women.
