Thane, A court in Maharashtra's Thane district has acquitted an undertrial prisoner accused of attacking a staffer at the Central Jail in 2019.

Thane district Additional Sessions Judge GT Pawar said the prosecution had failed to prove charges under Indian Penal Code section 353 (assault on public servant) and other relevant provisions against alleged accused Sameeruddin Mahmudan Mohammad Khan.

A copy of the order dated May 30 was made available on Saturday.

The prosecutor told the court that on June 2, 2019, an inmate in Thane Central Jail had a fight with another inmate and abused and assaulted him.

Khan and another prisoner became involved in a fight, injuring four prisoners.

Three jail staff intervened and resolved the dispute, and a case was later registered against Khan and three others.

Since Khan was behind bars for more than four years, the chargesheet against him alone was filed separately, and the trial was separated from that of other accused by an order dated January 5, 2024.

During the trial the prosecution examined five witnesses.

The judge said that the witnesses in the case failed to identify the accused before the court.

The court said that the prosecution had failed to bring on record any material to show that the accused, along with other accused, was involved in the alleged tussle or attacked the jail staff.
