New Delhi: The Supreme Court is scheduled to hear on Monday a plea by the Haryana government against a Supreme Court order striking down the state's policy of awarding extra marks to its residents in recruitment exams.

A vacation bench comprising Justices Abhay S Oka and Rajesh Bindal will hear the plea filed jointly by the Haryana government and the state recruitment commission challenging the May 31 order of the high court.

On May 31, the Punjab and Haryana High Court struck down the state government's policy of awarding five per cent bonus points based on the socio-economic criteria of the candidate, who is a resident of the state, on the total percentage of points in the Common Eligibility .Test (CET) for Group C and D posts.

It decided that no state can restrict employment to its own residents only by allowing the benefit of 5 per cent weightage in frameworks and said: "The respondents (state government) have created an artificial classification for similarly situated candidates applying for the position. "

The apex court had further said: "Though we mainly agree that the State has to follow the provisions which are for the welfare of the people, they cannot create an artificial classification which results in discrimination between people in similar positions. All candidates "Those who apply for the position have the same right to be selected based on the common examination carried out for all."

The verdict criticized the federal government for its policy and stated that it had carried out the entire selection in a "completely careless" manner.

"The notification of award of 5% bonus points on socio-economic criteria and experience is not based on any rule made under the provision of Article 309 of the Constitution of India. It is also noted that no data was collected earlier to establish this bonus.

The state government policy was implemented on May 5, 2022 and affected 401 categories of jobs in 63 groups for which the Common Eligibility Test (CET) was conducted.

The top court had quashed the CET results declared on January 10, 2023 and the subsequent results of July 25, 2023, and directed that a new merit list be prepared solely on the basis of the CET marks of the candidates.
