New Delhi [India], The Supreme Court on Tuesday suspended the sentence of Congress MLA from Cuttack-Barabati constituency of Odisha, Mohammed Mokim, in a corruption case. A bench of Justice Surya Kant and Justice Dipankar Dutta gave this order while hearing the appeal of Congress MLA Mokim. The bench also issued notice to the state government on Mokim's appeal against the Orissa High Court verdict. Mokim was represented by senior advocates Mukul Rohatgi and Muralidhar, along with advocate on record Mithu Jain. In his appeal, Mokim challenged the judgment of the Odisha High Court dated 10 April 2024, whereby the High Court upheld his conviction and sentence passed by the Special Judge, Vigilance, Bhubaneswar.The Bhubaneswar court, vide judgment and order dated September 29, 2022, convicted the MLA in a corruption case and sentenced him to three years of rigorous imprisonment. Mokim, in his petition, said that there is not a single shred of documentary or oral evidence to prove that the petitioner stood as a guarantor in the loan of Rs 1.5 crore or that the loan was actually disbursed to Metro Builders Pvt. Ltd. And there is no evidence on record to prove that he and his company, namely Metro Builders Private Limited, have cheated or defrauded any person. According to the investigating agency, the then managing director of Orissa Rura Housing Development Corporation had illegally sanctioned and disbursed a loan amount of Rs 1.5 crore to Metro Builders Private Limited in 1994. He did this by abusing his position without any financial power.and without keeping adequate security for the loan amount, thereby causing wrongful financial loss to the Odisha Rural Housing and Development Corporation (ORHDC). Moquim was the managing director of Metro Builders Pvt. Ltd.
