New Delhi: The Supreme Court on Wednesday sought a response from the National Medical Commission (NMC) to petitions filed by foreign students of eight medical colleges in Rajasthan and the Ram Manohar Lohia institute here seeking stipend for internships like other medical graduates. Indians.

"Issue notice," the court said.

Advocate Tanvi Dubey, appearing for the petitioners, submitted that non-payment of stipend is a clear violation of their fundamental rights.

He said that if several other universities pay stipends to foreign medical graduates, there is no reason for this discrimination.

The present petition has been filed by foreign medical graduates currently doing internships in government medical colleges including Sirohi, Alwar, Dausa and Chhitorgarh in Rajasthan, he said.

"That in terms of the circular dated March 4, 2022 and May 19, 2022, issued by the National Medical Commission (NMC), it is categorically provided that the stipend should be provided at parity with Indian medical graduates," it is alleged in the allegations presented by said advocate Charu Mathur.

The pleadings said that the provision of stipend is governed by Clause 3 (Annexure IV) of the National Medical Commission (Compulsory Rotating Medical Internship) Rules, 2021. The petitioners, he said, are entitled to regular stipend.

"Previously, students had the presumption that, according to the Regulations, they would receive a stipend during the period of their internship. However, they were surprised to find that when they joined the internship, they were forced to undertake Affidavit that the internship will be without any stipend.

"It was a complicated situation for the students as they had no choice but to sign that undertaking. When they joined the internship, they had no idea that they would have to incur huge daily expenses, including accommodation, travel, etc. They were shocked. point out that even the expenses related to rural displacement had to be assumed by them," the statement reads.
