Kejriwal, the AAP national coordinator, had sought from the high court not for bail but for a ruling that his arrest was illegal, BJP MP Bansuri Swaraj said at a press conference here.

"The Supreme Court did not provide any relief on this prayer on its part, rather it found that the ED (Enforcement Directorate) has sufficient evidence to prove the requirement of Section 19 of the PMLA that an accused is prima facie guilty. This is the seal of approval of the Supreme Court," he said.

Aam Aadmi Party (AAP) leaders at a press conference hailed the Supreme Court order as a victory for truth and accused the BJP of conspiring to jail Kejriwal in the 'fake' excise policy case. .

The prime minister, however, will remain in jail as the Central Bureau of Investigation (CBI) arrested him in a corruption case related to the alleged scam while he was in ED custody.

Swaraj alleged that the AAP was "misleading" the people and the media.

"The (Supreme Court) order is not a victory for Kejriwal, rather the court has put a seal on the allegation that he is guilty in the excise policy case and the ED has enough evidence of this," stated the New Delhi parliamentarian.

The interim bail granted to Kejriwal is because a question of law was referred to a larger bench of the Supreme Court and something referred to a larger bench has been under hearing for some time, he said.

Swaraj claimed that a few days ago, the ED filed a detailed charge sheet in a trial court in which Whatsapp chats and other evidence showed that the prime minister is the "kingpin" of the "liquor scam" and has "close relationships." with the co-defendant in the case.

"It also showed that AAP coordinator Kejriwal took Rs 100 crore in 'bribes' in the liquor scam, of which Rs 45 crore was used by AAP in the Goa assembly polls. As a result, the "AAP became the first political party in the history of the country to be named as a defendant in a charge sheet for a corruption case," he stated.

The Supreme Court has also hinted that whenever a constitutional officer is involved in such a corruption offence, that person should resign from his post, the BJP leader said.

But Kejriwal is attracted to power because he is not willing to step down as chief minister, Swaraj alleged.

Granting bail to Kejriwal, the Supreme Court said it is for Kejriwal to decide whether he should continue as chief minister.

"We are aware of the fact that Arvind Kejriwal is an elected leader," a bench of Justices Sanjiv Khanna and Dipankar Datta said, while noting that Kejriwal has suffered imprisonment for more than 90 days.
