ISLAMABAD [Pakistan], The Supreme Court on Thursday issued a direction, ordering both private entities and government bodies at the provincial and federal levels to remove all encroachments on footpaths for safety purposes within a strict three-day time limit , as per Dawn report. The order was given during a session presided over by Chief Justice of Pakistan Qazi Faiz Isa and also comprising Justices Jamal Khan Mandokhail and Nai Akhtar Afghan. The case stems from a 2010 petition filed by former Karachi mayor Naimatullah Khan, seeking court intervention to reclaim the land. Additionally, the court addressed around 145 other cases related to encroachment on public spaces, illegal construction and unauthorized conversion of residential properties into commercial properties, according to Dawn. After the proceedings in the Gujjar, Orangi and Mahmudba Nala cases ended for the day, Justice Isa remarked that the government has a big responsibility to answer for any encroachment, adding that it is the responsibility of the Governor House, Chief Minister House, Nava Headquarters The footpath outside, the Rangers headquarters, and the SC were all encroached upon by the government, he said, adding that they had removed all such constructions outside the Karachi registry of the top court "Do you have the right to close the footpath?" The CJP questioned an additional advocate general of Sindh, to which the latter replied, “No, but these [encroachments] have been done to ensure the safety of these offices and buildings from bomb threats.According to Dawn, Justice Isa further asked, "So the public can be attacked, but you must be safe. What kind of law is this?" The Chief Justice later directed that outside provincial and federal government authority offices and private entities All footpaths should be cleared or the court will issue contempt notices to those who blocked them, he said, adding that footpaths were meant for pedestrians, and if officials wanted to block entry, CJP Isa commented. "They do it outside because how can they let anything happen on their lawn," CJP Isa remarked, emphasizing that barricading around the world was done inside buildings, while "the sidewalks are on their "If the law enforcement agencies are so scared, they should leave these places and set up their offices in remote areas," CJP Isa said.The Advocate General of Sindh assured the court that the government will remove all encroachments from the footpaths. Addressing the Advocate General and the federation, CJP Isa said, "It is unfortunate that the encroachments are done by people who get paid from the government treasury . You are here to serve the people, not to protect yourself. Pronouncing the order of the day, Justice Isa directed all land-owners of the agency to remove all encroachments from footpaths within three days. Three days later, he said that the encroachments should be demolished by the relevant authorities, adding that the cost of that exercise would be paid for by the senior state official in the building at the fault of Karachi Metropolitan Corporation lawyer Omar.Lakhani assured the court regarding removal of all encroachments on footpaths adjacent to 106 roads falling under the jurisdiction of the corporation. Following this development, the case was adjourned till tomorrow.
