ISLAMABAD: A high court in Pakistan on Tuesday disposed of Bushra Bibi's plea seeking her transfer to the high-security Adiala jail, where her husband, former Prime Minister Imran Khan, is imprisoned.

Islamabad High Court disposed of his petition as his lawyer did not appear in the court.

Bushra Bibi is currently lodged in Bani Gala - 71-year-old Khan's home in Islamabad - which was converted into a sub-jail after her sentencing in the 'non-Islamic Nikah' case in February.

The Islamabad High Court (IHC) disposed of a petition filed by the 49-year-old former first lady seeking her transfer from Bani Gala to Rawalpindi's high-security Adiala jail, Dawn newspaper reported.

Bushra Bibi's lawyer did not appear in the court after which Justice Miangul Hasan Aurangzeb disposed of the petition.

Questioning why Bushra Bibi's lawyers were absent, Justice Miangul Hassa Aurangzeb said, "If they had won this case, Bushra Bibi [Adiala] would have gone to jail, but they (lawyers) themselves do not want Bushra Bibi should go to jail.,

Bushra Bibi's lawyer Usman Gill, who reached the court after the disposal of the petition, was asked by the judge to file an application for its reinstatement.

Khan, founder of the Pakistan Tehreek-e-Insaf (PTI) party, has been lodged in Adiala jail since August last year.

Earlier in January, Khan and Bushra Bibi were sentenced to 14 years in prison in the Toshakhana corruption case related to the illegal sale of government gifts that the former prime minister received during his tenure.

Following the verdict, Bushra reached Adiala jail to surrender before the authorities and was later taken into custody by the National Accountability Bureau.

However, he was taken to his Bani Gala residence after it was declared a sub-jail in a late night notification, the report said.While his sentence in the Toshakhana corruption case was suspended by the IHC, Bushra Bibi remains in custody in the 'non-Islamic' marriage case, while Khan is also in jail in other cases.

Bushra Bibi's shifting has been under discussion for several weeks as the former first couple have refused to submit any application to declare their residence a sub-jail.

About a week after his arrest, he challenged his residence status as a sub-jail, and urged the IHC to allow him to complete his 14-year sentence in Adiyal jail.

In a subsequent hearing, the court was informed by Adil Jail authorities that Bushra Bibi could not be transferred to the jail due to "secret threat".

On Monday, Bushra Bibi moved the IHC seeking a medical examination at Shaukat Khanum Hospital, owned by Khan's charitable organisation, alleging that she was poisoned during her captivity in Bani Gala.Earlier this month, during the hearing of a corruption case in Adiala, Jai Khan informed the judge that an attempt was made to poison his wife and said that "poison" appeared on her skin and tongue as a side effect.
