In February 2018, Umakant Yadav was hit by a BEST bus while crossing the road in Kalachowki, Mumbai, and died in hospital.

In their application, Yadav's wife and daughter claimed that the bus was driven negligently, while Best argued that the deceased was under the influence of alcohol when the accident occurred.

The woman and her daughter demanded Rs 25 lakh as compensation and interest, saying Yadav worked in an oil depot and was earning Rs 15,000 per month at the time of the accident.

In its order dated April 3, MACT Mumbai said the claimants had proved that the accident was caused by negligent driving of the BEST bus.

MACT said BEST has not brought on record any evidence of Yadav being drunk at the time of the accident.

However, the tribunal said that the family of the deceased could not prove his occupation and income.

"In the absence of any proof of income, but considering the fact that the deceased was supporting a family of four, R8,000 per month is taken as the estimated income of the deceased," the MACT order said. It would be fair and reasonable to believe.”

It directed BEST to pay Rs 15.66 lakh including interest as compensation. MACT said that out of this amount, Rs 7 lakh will be given to the daughter of the deceased and the rest to his widow.
