The Court asked what was the need to retain the report received by the Vijayan government in 2019 without any follow-up.

After accepting the PIL on its record, the Court directed the government to file a detailed affidavit on its views, hand over the entire Hema Committee report in a sealed cover and sue the Kerala State Women's Commission.

In the PIL, the petitioner pointed out that it was strange that the state government did not act on the report despite having it with it since 2019.

The petitioner further claimed that the state government did not register a case based on the Hema Committee report.

The division bench comprising Acting Chief Justice A. Muhamed Mustaque and Justice S. Manu said, "If any cognizable offense is revealed in the committee, this court will decide whether criminal action is necessary or not." The government is now unable to proceed in this matter for the simple reason that no one has filed a complaint, but the fact is that the report reveals how to protect these vulnerable women and what action can be taken against them. of the crime is something that the court must address. Accordingly, we allow this writ petition and await the government's position on the matter.

The court also noted that the problem was that the parties want to maintain anonymity and are a vulnerable section of women who do not wish to reveal the harassment in public.

She further stated that there is a need to address this issue and take measures to protect these vulnerable women.

The court then published the case on September 10.

Meanwhile, opposition leader V.D. Satheesan reiterated that the Vijayan government was protecting the accused who acted as villains against actresses and criticized the Vijayan government's decision to organize a film conclave to discuss these issues.

“What good is this conclave when the accused and the victims will be sitting together? If such a conclave is held, the opposition will firmly prevent it from taking place,” Satheesan said.

Differences of opinion have emerged in Vijayan's cabinet after State Finance Minister K.N. Balagopal said the state government could take action based on the report, while CM Vijayan and state Film Minister Saji Cherian disagreed.

“Now that the court is examining the report, we will wait for it and put aside all other things,” Cherian said.
