New Delhi, The Delhi High Court on Tuesday issued a notice to a real estate company over former Indian cricketer Yuvraj Singh's pleas seeking to invoke arbitration laws for alleged violation of his privacy rights in promoting construction projects and for the delay in the delivery of a housing unit to him in the national capital.

Justice C Hari Shankar sought Brilliant Etoile Private Limited's response on Singh's two applications for appointment of an arbitrator to hear and resolve disputes between him and the builder.

The high court listed them for further hearing on August 5.

In one of the statements filed through lawyer Rizwan, the cricketer said that a sale agreement was signed between him and his mother on one side and the builder on the other for the purchase of an apartment for over 14 million rupees in the real estate project started by Brilliant Etoile Pvt Ltd in Hauz Khas under the name 'Sky Mansion' and displaying the name 'Risland'.

In the other allegation, he said that a Memorandum of Understanding was signed between him and the builder in order to promote, endorse and market the real estate project.

However, the builder allegedly acted in violation of the terms of the Memorandum of Understanding and the agreement to hand over possession of the apartment, according to the allegations.

“Pursuant to the receipt of the possession letter, the petitioners inspected the apartment and to the utter surprise and dismay of the petitioners, it was discovered that the same was in complete disregard of the standards of quality, level, specifications and finishes promised at the time. of the execution. of the agreement.

"It is submitted that the respondent compromised the quality of the material used and lowered the quality of the accessories, furniture, lighting and finishing of the apartment. The same does not match the standard attributed to the sample displayed and promised to the petitioners in terms of the agreement,” the petitions said.

As per the MoU, the cricketer was to promote and endorse the project and the MoU expired on November 23, 2023. He is aggrieved by the alleged continued commercial use of the services he provided, including the use of his photographs on billboards, projects . site, social media posts and articles despite the expiration of the MoU, he said.

The former India all-rounder said the alleged continued use of his image and that of others constituted a complete violation of his copyright, personality rights and right of publicity enshrined in laws and protected as his intellectual property rights.
