Gurugram, Haryana Real Estate Regulatory Authority (HRERA), Gurugram, has imposed a fine of Rs 5 million on city-based real estate developer Vatika Ltd for not registering its project within the stipulated time.

The penalty was imposed for violation of Section 3(1) of the Real Estate (Regulation and Development) Act, 2016, an official said on Tuesday.

The authority noted that Vatika Ltd obtained a license for its Vatika India Next residential real estate project in 2013 from the Haryana Department of Town and Country Planning (TCP).

The promoter had to apply for RERA registration within three months of the Act being notified in the state in 2017, according to an official release.

However, Vatika Ltd applied for registration after RERA took suo motu action based on a notification from the Haryana government in 2022.

Arun Kumar, president, HRERA Gurugram, said, "It was an ongoing project and the promoter should have applied for RERA registration on time to avoid penalties. HRERA registration is mandatory for all ongoing real estate projects where certificates of competence". not issued before the Law came into force in 2016."

According to section 3(1) of the 2016 Act, "No promoter shall advertise, market, reserve, sell or offer for sale or invite persons to purchase in any manner any land, apartment or building, as the case may be, in any real estate project or part thereof, in any planning area, without registering the real estate project with the Haryana Real Estate Regulatory Authority established under the Act.”

Subsequently, once the promoter submits all the mandatory approvals for project registration, the authority approves the project registration.

The authority also concluded criminal proceedings for violation of Section 3, which is an offense punishable under section 59 of the 2016 Act, and imposed a fine of Rs 5 million, he said.

“Due to the development of NH 352 W passing through our project and lack of information from GDMA regarding road alignments, we were not able to finalize our service estimates, which HRERA compulsorily requires for registration processing.

"We have complied with the imposition of the sanction by HRERA and will always comply with what the regulators deem appropriate with the utmost respect and humility," a Vatika Group spokesperson said.
