Thursday, May 2, 2024: Handbook on the Rights of Transgender-Gender-Diverse Persons in India unveiled by Honorable Justice A.K. carried out by. Sikri, former Judge, Supreme Court of India, and Professor (Dr.) C. Raj Kumar, Founder Vice-Chancellor, O.P. Jindal Global University, in the presence of stakeholders and activists of the trans justice movement.

This handbook was prepared by Jindal Global Law School's Law and Marginalization Clinic, Center for Justice, Law and Society (CJLS) under the supervision of Professor Deepika Jain and Natasha Aggarwal as part of the clinical course titled "Trans Justice and the Law". Has been. Clinic in collaboration with the Transmen Collective, Eagle, and the Feminist Future Initiative at the University of California, Santa Barbara. The handbook highlights the Transgender Persons (Protection of Rights) Act, 2019 and seeks to empower transgender persons to claim their constitutional and statutory rights as gender-diverse persons.In the special address, Justice A.K. Sikri (former judge, Supreme Court of India) stressed the importance of the handbook, and highlighted his experiences in writing and delivering the Supreme Court judgment in National Legal Services Authority vs Union of India in 2014. He said, “We have come a long way from the judgment to the Act and now resources like this booklet that will help the community realize their rights and fulfill the promises of the Constitution of India. Justice Sikri explained the importance of identity not only from a jurisprudential perspective but also to ensure respect and dignity within the society. In the welcome address, Professor (Dr) C. Raj Kumar (Founder Vice Chancellor O.P. Jindal Global University ) emphasized JGU's commitment to clinical legal education and commented that, "It is important for law schools to ensure engagement with social justice movements." He also emphasized the intellectual rigor and collaborative approach required to develop a handbook that is comprehensive, accessible, and can be used by activists and community members on the ground.Introducing the Handbook, Professor Deepika Jain, Professor of Law, Vice Dean Director, Law and Marginalization Clinic, Center for Justice, Law and Society Jindal Global Law School and Natasha Aggarwal, Clinical Assistant Professor o Law, Jindal Global Law School said Ki La A Marginalization Clinic's work is based on intersectionality and a community-centered approach. The purpose and outcomes of each clinical project are modeled after the trans movement. The Handbook is no exception, as Friends of the Trans Movement have stressed the need for a resource that comprehensively deconstructs the Transgender Persons Act. He also expressed great gratitude to members of the trans, gender-diverse and intersex communities who offered their expertise and feedback through consultative processes and reviews.

The handbook highlights the provisions of the Transgender Persons Act, Transgender Persons Rules, relevant judgments of the Supreme Court and various High Courts, as well as state-specific welfare schemes for transgender and gender-diverse persons., The panel was moderated by Dr Aqsa Shaikh (Professor of Community Medicine Founder of Human Solidarity Foundation). Advocate Madhavi Divan discussed important provisions of the Transgender Persons Act and the lack of affirmative action and assistance in obtaining identity cards for transgender persons. Touched upon some limitations of the law, including procedural complexities. Ritwik Dutta also discussed the implementation of welfare schemes under the Transgender Persons Act, especially noting the lack of implementation of the Smile Scheme in North-East India. Similarly, Akkai Padmashali pointed to the limited number of identity cards issued, which has resulted in a negative impact on the number of transgender individuals registering to vote.

Dr. Aqsa Shaikh and Nu Mishra emphasized on the value and importance of the handbook.In particular, Nu Mishra appreciated the visual element and inclusion of artwork, noting that art is often a tool of advocacy among activists. Dr. Aksa also highlighted the ways in which the handbook draws from lived experiences and Highlights how the law can be used in each of these situations..
