While there is currently no provision for maternity leave for women government employees, the new amendment to the Central Civil Services (Leave) Rules, 1972, will provide major relief to "surrogates (women who bear the child for the commissioning mother)". Also a commissioning mother with less than two living children (expected mother of a child born through surrogacy).”

The new rule also applies to male government employees who have less than two surviving children.

According to a June 18 notice issued by the Ministry of Personnel, Public Grievances and Pensions, the "commissioning father" (the intended father of a child born through surrogacy) will also be able to get 15 days of paternity leave.

As per the existing rules, "a female Government servant and a single male Government servant" can avail Child Care Leave up to 730 days during their entire service for the care of their two eldest surviving children.

These leaves can be taken to raise children or to meet some of their needs, such as education or illness.
