Thane, A Thane court sentenced a man to 20 years of rigorous imprisonment for raping a minor girl, who he considered her "mom" (maternal uncle), observing that the crime was "heinous and disgusting" and needed to be dealt with. with a heavy hand. .

The 54-year-old accused does not appear to have respected the relationship of a foster maternal uncle with the girl, POCSO special judge Ruby U Malvankar said in a July 5 order.

A copy of the order was made available Monday.

The man was convicted on charges of rape, criminal intimidation and under various sections of the Protection of Children from Sexual Offenses Act (POSCO).

Special public prosecutor Rekha Hiwrale told the court that the victim, then 16, approached the police in 2018 with a complaint, saying he lived with her father and two brothers in the Manpada area of ​​Thane district of Maharashtra. .

In August 2017, her adoptive maternal uncle, a cook by profession and a native of Ahmednagar, came to stay at her house.

He behaved well for a few days, but starting in September he started touching her on some pretext when no one else was home.

One night, when the girl's father was drunk and asleep, the defendant touched her inappropriately and raped her, prosecutors told the court.

When the girl screamed, the accused gagged her and threatened to kill her if she reported the incident to anyone.

Following the threat, the girl did not tell anyone about the crime and the defendant subsequently frequently touched her inappropriately.

When she told him that she would inform her father, the accused left her place.

Based on the girl's complaint, the police registered an FIR on June 16, 2018.

The judge in her ruling stated that the crime proven against the defendant is "very heinous and repugnant."

"He committed the said crime with a girl under 16 years of age who used to treat him and call him 'mom,'" the court said.

"The accused does not appear to have respected the relationship of an adoptive maternal uncle with his daughter, who appeared to be his niece. This type of act between such relationships is certainly not acceptable and deserves to be condemned and dealt with harshly to send to the appropriate authorities. message in society to like-minded people to act as a deterrent," he said.

The court also imposed a fine of Rs 22,000 on the accused, saying it will be paid to the victim to ensure her rehabilitation.

He also ordered that the sentence be forwarded to the District Legal Services Authority (DLSA) for due compensation to the victim.
