After watching video footage of the incident, a bench headed by Justice Arvind Kumar said the allegation of EVMs being thrown to the ground was a "sheer mockery of the system", adding that if the order granting interim protection was not stayed, This would be a mockery of the entire justice system.

In its order, the bench, also comprising Justice Sandeep Kumar, took note of the undertaking given by senior advocate Vikas Singh, representing Ramakrishna Reddy, that the YSRCP Macherla MLA would not enter the counting venue and its surroundings on Tuesday.

Further, the top court asked the Andhra Pradesh High Court to decide the anticipatory bail petitions on merits without being influenced by its previous observations granting interim protection.

In an interim order passed on May 23, the Andhra Pradesh High Court had restrained the police from taking any action against them till June 5 in the case related to the destruction of electronic voting machines (EVMs) during polling.

Against this, a polling agent of the Telugu Desam Party filed a petition in the Supreme Court alleging that Ramakrishna Reddy, using his influence, asked the VRO to file a report as if unknown people had damaged the EVMs in the polling booth.

Ramakrishna Reddy, who is seeking re-election from Macherla as a YSRCP candidate for the fifth consecutive time, has been booked by the police under relevant sections of the Indian Penal Code (IPC), Representation of the People Act, 1951 and prevention of punishment.The Prevention of Damage to Public Property (PDPP) Act, 1984 was violated after a video of EVM breaking went viral.

The incident occurred on May 13 at a polling booth in Macherla during simultaneous voting for the Assembly and Lok Sabha in Andhra Pradesh.

In a video that went viral on May 21, he can be seen walking into a polling booth and throwing an EVM on the ground. Taking the incident seriously, the Election Commission had ordered his arrest.

Additionally, three new cases were registered against him for allegedly inciting violence on the polling day.
