New Delhi [India], Delhi LG VK Saxena has approved the prosecution of author Arundhati Roy and former professor of international law at the Central University of Kashmir Sheikh Shaukat Hussain in a case related to their inflammatory speeches at a public function. in 2010, an official statement from the LG office said on Friday.

The LG approved the prosecution of Arundhati Roy and Sheikh Shaukat Hussain under IPC section 45 (1) of the Unlawful Activities (Prevention) Act.

The FIR in the case was registered on 28 October 2010 on the complaint of Sushil Pandit.

Earlier, the LG had given sanction under section 196 of the IPC in October 2023 to prosecute the above accused for offenses punishable under sections 153A, 153B and 505 of the IPC.

Roy and Hussain had reportedly given provocative speeches at a conference organized under the banner of "Azadi – The Only Way" at LTG Auditorium, Copernicus Marg, New Delhi on October 21, 2010. Among the issues discussed and talked about in the conference was the promotion of "separation of Kashmir from India".

Those who spoke at the conference included Syed Ali Shah Geelani, SAR Geelani (anchor of the conference and the main accused in the Parliament attack case), Arundhati Roy, Dr Sheikh Shaukat Hussain and Maoist supporter Vara Vara Rao.

It was alleged that Geelani and Arundhati Roy strongly propagated that Kashmir was never a part of India and was forcibly occupied by the Indian armed forces and made every possible effort for the independence of Jammu and Kashmir from India. The complainant filed a complaint under Section 156(3) of CrPC before the MM Court, New Delhi, which disposed of the complaint vide order dated November 27, 2010 with directions to register an FIR. Accordingly, an FIR was registered and investigation conducted.
