The court observed a gross lack of will among state functionaries to address these violations, which not only affect public health but also involve extreme cruelty to animals.

A division bench of Acting Chief Justice Manmohan Singh and Justice Manmeet PS Arora made these observations while hearing a petition filed by Sunaina Sibal, Asher Jesudos and Akshita Kukreja alleging violation of various laws in Delhi's dairy colonies.

The bench remarked, "These violations not only affect the health of the citizens and residents who consume the milk produced in these dairies, but also amount to extreme cruelty towards the animals kept in these dairies."

The court noted "gross dereliction of duty" by the Delhi government's animal husbandry unit, saying the unit had failed in its primary function of licensing and regulating these dairies under the 1978 rules.

Further, the court also noted the absence of functional and stocked animal hospitals in these nine dairy colonies.The court criticized the state's reluctance to relocate the Ghazipur and Bhalswa dairy colonies despite their proximity to the landfill and the adverse impact on public health.

“It also appears to this Court that shifting of Ghazipur and Bhalswa Dairies would require alternative land within or outside Delhi, and therefore, the presence of the Ministry of Housing and Urban Affairs of the Government of India through the Secretary Is. ,” the court said.

As a result, the court made the Drugs Controller General of India, the Central Drugs Standard Control Organisation, the Ministry of Health and Family Welfare, the Ministry of Fisheries and the Ministry of Housing and Urban Affairs as parties to the case.

Last month, the court had issued directions to deal with the use of fake oxytocin hormone in dairy colonies across the national capital, stressing the need to address animal cruelty and public health concerns.The court had asked the drug control department, GNCTD, to conduct the investigation. Carry out regular inspections and ensure that cases of use or possession of counterfeit oxytocin are registered under relevant laws.

The Intelligence Department of Delhi Police was tasked with identifying the sources of oxytocin and taking legal action against the culprits.

The petition states the need to relocate dairies to areas with adequate infrastructure and sanitary conditions to protect public health and prevent animal cruelty.

Expressing concern over dairies located near landfill sites, the court had stressed the urgent need to relocate such facilities due to potential health hazards posed by contaminated feed and milk.The officials were tasked with coordinating efforts to find suitable resettlement sites and address complex issues related to dairy operations in Delhi.
