New Delhi [India], The Delhi High Court has sought a response from the Ministry of Defense and other Army-related departments on a plea submitted to a licensed arms supplier against rejection of its offer to supply close range combat carbines (CQB) to Armed Forces worth Rs 12,000 crore.

This petition has been filed through law firm Lex Panacea by BSS Materiel Limited, which is an authorized supplier of Indo Russian Rifle Private Limited (IRRPL). IRRPL is a joint venture of India and Russia and manufactures CQB in Amethi.

A division bench headed by acting Chief Justice Manmohan sought the Defense Ministry's response before the next hearing date on August 9. The court issued notice on the petition in late April.

The court had notified the Defense Ministry, Chief of Defense Staff, Secretary DMA and five others, including the Additional Director General (ADG) Technical Procurement (Army).

It is claimed that the IRRPL had floated a bid to supply 425213 CQB to the armed forces through BSS Material Limited. His offer was rejected by the Ministry.

Petitioner BSS Materiel Limited has challenged a letter it received from ADG Acquisition on December 11, 2023, stating that its techno business offering is "non-compliant" for not meeting the financial criteria of average annual turnover and net worth stipulated in the Application. for Proposal (RFP).

This offer was submitted on May 2, 2023, as an authorized supplier of the original equipment manufacturer, the statement added.

Petitioner BSS Materiel Limited has sought directions to quash the letter of ADG Acquisition and declare it in conformity with the RFP.

You have also sought a direction that will allow you to participate in the evaluation procedure free of charge and a future direction to participate in the evaluation procedure according to the testing methodology that is part of the RFP.

It is submitted that there is significant ambiguity and it is a flagrant violation of the Doctrine of Equality enshrined in Article 14 of the Constitution of India.

The financial criteria by which the entity would be examined are not discussed in the RFP, the pleading states.

It is also submitted that the petitioner submitted its bid/response to the RFP as a small medium enterprise (SME) which the respondent also recognizes without demanding the earnest money deposit (EMD) required for submitting a response to the RFP.

Petitioner BSS Materiel Limited also claimed that he sent a letter to the Technical Evaluation Committee (TEC) in July and August 2023 to assess the annual turnover and net worth of original equipment manufacturer (OEM) IRRPL.
