Justice Subramaniam Prasad, who is overseeing the case, directed the entire amount to be repaid with an interest rate of 12 per cent from January 30, 2021 to the present, stressing the significant emotional and financial impact on the buyer.

This decision has been taken after home buyers faced more than six years of delays and uncertainty, causing a lot of distress.

The court's decision cited a serious breach of trust and a heavy emotional burden on the buyer, who was expecting to take possession of the home with his life's savings.

NBCC had argued that the plaintiff had sought similar relief through multiple forums, Justice Prasad rejected this claim citing the plaintiff's desperation for resolution.

The court criticized state unit NBCC for the way it handled the case and said their actions required a strong response. Apart from the refund, the court has also awarded a compensation of Rs 5 lakh to the plaintiff for the hardships endured.
