The suit relates to the suspension of the Instagram page of TV Today magazine Harper's Bazaar India (bazaarindia) over copyright issues.

Justice Anish Dayal has sought response from Backgrid USA and Meta Platform regarding TV Today Network's application for restoration of its Instagram handle.

The controversy stemmed from a post on Bazaar India's Instagram account containing pictures of international celebrities in various fashion attire.

BackGrid USA filed three copyright strikes against these posts, leading the Met to deactivate the Instagram account on March 15.

TV Today Network claimed that the use of the photographs fell under the "fair use" provisions mentioned in Section 52 of the Copyright Act.Met Platforms advised TV TODAY Network to negotiate directly with BackGrid USA.

According to advocate Hrishikesh Baruah, representing TV Today, despite efforts to communicate and negotiate with the US-based company, TV Today's efforts were rejected by Backgrid USA.

The court has now asked Backgrid USA and Meta Platforms to respond to the allegations and the request to restore the Instagram account.

TV Today Network had earlier this month moved the court challenging the constitutional validity of Rule 3(1)(c) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

The rule in question mandates intermediaries to periodically inform users about their rights and the consequences of non-compliance with the rules and regulations.TV Today Network had argued that the rule violates constitutional provisions as it sought to align it with existing laws and constitutional articles.

It also expressed its grievance over the suspension of Harper's Bazaar India's Instagram account due to copyright complaints by third parties.
