New Delhi [India], The Delhi High Court on Monday acquitted a man who was booked under the Protection of Children from Sexual Offenses (POCSO) Act, 2012, saying there were inadequacies in the prosecution's case and There are contradictions. The high court also said that the prosecution had failed to prove the charges beyond reasonable doubt. The High Court said that just as wrongful acquittal shakes people's faith, wrongful conviction is much worse. The Court also said that false implication in child abuse cases is more painful than the prosecution's punishment. Justice Anup Kumar Mendiratta said the prosecution case is replete with inadequacies and contradictions which attack the crux of the prosecution case and as such, the prosecution failed to bring out charges against the accused beyond reasonable doubt for "being a child abuser." One, even in the event of a false accusation, continues to suffer a lot of social stigma, which is much more painful than the rigors of trial and imprisonment,” Justice Mendiratta said in the judgment passed on April 15, directing the appellant to Five years' imprisonment and a fine of Rs. The appellant has also been directed to pay compensation of Rs 4000 for the offense punishable under Section 10 of the POCSO Act, 2012 and Section 506 of the IPC. Compensation of Rs 20,000 was given to the victim. A case was registered at Jaitpur police station in 2016 under POCSO and other sections of the IPC. The High Court said that it cannot be denied that the case is based on tuition or a fabricated story due to enmity and marital disputes. The court said that it can also be seen that the victim also refused to undergo internal medical examination without any solid reason. The High Court also said that the victim, on her own discretion, changed her statement regarding the act committed by the appellant.
