Mumbai: The Congress has urged the returning officer of the biennial Maharashtra Legislative Council elections not to allow BJP MLA Ganpat Gaikwad, accused of firing at a Shiv Sena leader inside a police station, to cast his vote.

In a letter to the returning officer, Congress candidate Pradnya Satav's representative Abhijeet Vanjari said Gaikwad is in judicial custody and cannot vote under Section 62(5) of the Representation of the People Act, 1951.

“We have heard that Gaikwad will come to Vidhan Bhavan to vote. Please stop him from doing so illegally… and protect constitutional values ​​without giving in to any pressure. Otherwise, we will have to take legal recourse,” the letter said.

Gaikwad, who represents Kalyan East assembly constituency, was arrested in February for firing at a Shiv Sena functionary inside a police station in Ulhasnagar in Thane district over a land dispute.

The BJP MLA is in judicial custody after the incident.

The biennial elections for 11 council seats are being held on Friday between 9 am and 4 pm at the Vidhan Bhawan complex in south Mumbai.
