A key aspect that is being incorporated in the latest notification is the central government's focus on increasing efficiency in spectrum usage and various ways to achieve it such as secondary assignment, sharing/trading etc., the communications ministry said in a statement.

The government issued a notification to invoke sections 6-8, 48 and 59(b) of the Telecom Act. 2023 with immediate effect. The main features of the segments that have been implemented include optimum utilization of spectrum.

"The Act provides a legal framework for efficient utilization of scarce spectrum through processes such as secondary assignment, sharing, trading, leasing and surrender of spectrum," the ministry said.

It also enables the use of spectrum in a flexible, liberalized and technologically neutral manner while empowering the government to set up an enforcement and monitoring mechanism for this purpose.

The Act also provides for, with immediate effect, the use of any device that intercepts telecommunications, unless permitted by the Government.

The Telecommunications Act 2023 aims to amend and consolidate the law relating to the development, expansion and operation of telecommunications services and telecommunications networks; assignment of spectrum; And for matters connected therewith. "The Telecom Act 2023 also seeks to repeal the existing legislative framework such as the Indian Telegraph Act 1885 and the Indian Wireless Telegraphy Act 1933 due to the huge technological advancement in the telecommunication sector and technologies," the ministry said.
