Chief Metropolitan Magistrate Vidhi Gupta Anand rejected the bail plea of ​​Dr Akash after hearing the arguments of the defense counsel and an Additional Public Prosecutor (APP).

Dr. Akash's lawyer Naveen Kumar Singh argued that he (Aakash) is neither an employee nor in a supervisory capacity.There is no appointment letter.

He is a Bachelor of Ayurvedic Medicine and Surgery (BAMS). The lawyer said that in January 2024, he joined the hospital as a trainee.

It was also submitted that Akash was assisting the nursing staff. Treatment is done by Dr. Naveen Khichi. The accused never treated any patient nor prescribed any medicine.This is an old hospital. He is 26 years old; Can he be given supervisory powers? the defense lawyer asked. He (Aakash) was just following the instructions of the doctor and nursing staff.

It has also been said that it is an accident. This fire started due to short circuit on the second floor. Death was not due to burning but due to suffocation. In such a situation, how can he be responsible for all this?

The defense lawyer also said that there was a lack of procedure. If kept in jail, career will be ruined, the accused is from a poor family; That's not impressive, the lawyer said.He further said that the fire started from a cylinder used for the treatment of a patient on the second floor. They saved seven children before the police and fire staff arrived. There is a discrepancy between the date of arrest, 26 and 27 May.

The prosecution opposed his bail application. Additional Public Prosecutor (APP) argued that the allegations are serious. This offense is punishable with life imprisonment. This is subject to consideration by the Sessions Court.

This case should be transferred to the sessions court. The APP argued that the investigation was in its initial stages.It was also said that the accused was not a trainee. He was in overall charge at night. He ran away from the hospital. The general public was informed about the incidents. He did not inform the police or fire department; Instead, he called Dr. Naveen Khichi.

Delhi Police also said that a dead body was also kept in the ICU before this incident. The High Court is also related to this matter.
