This case pertains to the transmission of secret information related to the Indian Army. A special judge of the Tis Hazari Court in Pakistan said that the 'No Objection Certificate' by the concerned officer of the Indian Army has been placed on record by the accused persons in connivance with a soldier through the Pakistan High Commission. The documents which are secret, confidential have been leaked in the present case and to ensure security in future, corrective action has been taken by the Defense Forces on record in the present charge sheet. The said documents should not be misused against the security of the state in future., The court had asked the officer that since the classified documents available in the present charge sheet are part of a public document, whether the defense forces had ensured that the said classified documents could not be misused by any mischievous elements against the sovereignty of the country. This being against the security of the state in the future, the case has now been listed for debate on the charge in July. Earlier, the court had requested the top brass of the Indian Army to depute a commanding officer to appear before the court. The court had said that, according to a report by the Military Intelligence of the Indian Army, all the documents recovered from the other accused Habib U Rehman were classified secrets. Before passing the order, the special judge had taken note of the oral arguments of the investigating officer (IO) ACP Pankaj Arora, who had said that there were allegations that the documents recovered from accused Habib ur Rehman were military secrets of the Indian Army and on questioning, Accused Habib U Rehman revealed that these items were sent to him through accused Paramji Kumar, a military officer of the Indian Army under the commanding unit of AFSOD, headquartered at Agra Cantt, Uttar Pradesh.The IO had further stated that accused Habib ur Rehman further disclosed that he had used it. Providing these military secrets to an officer of the Pakistan High Commission in exchange of money paid directly or through the accused Mohsin Kha on the orders of the said officer of the Pakistan High Commission, it was further stated by the IO that the alleged role of the accused, Paramji Kumar , while posted as a military clerk, receiving official documents in an official capacity, he produced duplicate keys of the office as well as the office cupboard and he used to open the said locks and photographs of a confidential military Used to pull. The court had also said that the investigating officer has received a report from the Military Intelligence of the Indian Army that all the documents recovered from the accused Habib ur Rehman are confidential secrets and classified documents of the Indian Army and there is no possibility of any unauthorized disclosure of their contents.
