Responding to the government's appeal, Justice Rajeev Gupta and Justice Shiv Shankar Prasad overturned the acquittal of Pyare Singh and Chhotku after convicting them under Section 302 (murder) and other relevant sections.

The court directed the Chief Judicial Magistrate of Gorakhpur to ensure the arrest of both the accused and shift them to jail to serve their sentence.

The case dates back to September 22, 1978, when a man named Ganga was murdered, the next day an FIR was registered against seven people in Gorakhpur.

The High Court heard the plea and said in its judgment, "After considering the facts and circumstances of the case and examining the findings recorded by the lower court in acquitting accused Pyare Singh and Chhotku, we are of the view that That the evidence given by the prosecution has not been examined in the correct perspective as the prosecution has fully established the guilt of the accused at the trial stage, resulting in Pyare Singh and Chhotu. has been acquitted."
