Noida, According to an information obtained through the RTI Act, 10,46,163 motor accident claims worth Rs 80,455 crore are pending across the country and their number has increased steadily between 2018-19 and 2022-23.

The details have been provided by the Insurance Regulatory and Development Authority of India (IRDAI) in response to a query filed by Supreme Court lawyer KC Jain in April.

In his question to the Ministry of Road Transport and Highways (MoRTH), Jain has sought to know the total number of pending motor accident claims in the country along with state and district wise details.

He also wanted to know the annual details of claims filed during the last five years, settlement of the balance and the initiatives, if any, taken by the Center for speedy settlement of motor accident claims.

According to IRDAI information, the number of pending motor accident claims at the end of the financial years 2018-19, 2019-20, 2020-21, 2021-22 and 2022-23 were 9,09,166, 9,39,160, 10. 08,332, 10,39,323, and 10,46,163 respectively, whose claim amounts are Rs 52,713 crore, Rs 61,051 crore, Rs 70,72 crore, Rs 74,718 crore, and Rs 80,455 crore respectively.On regional level sharing of information, IRDAI said, "District-wise and state-wise details of motor third party claims are not available with IRDAI, IRDAI does not collect or maintain such detailed information."

Citing statistics, the Agra-based lawyer said the number of pending claims is increasing year on year, and there is also a delay in settlement of claims of dependents of persons deceased and injured in road accidents.

The road safety activist also expressed concern over the "tortoise pace" of clay settlements and estimated that it takes an average of four years for a victim to receive financial relief.

“If we look at the pace of claim settlement, the number of pending cases at the beginning of the financial year 2022-23 was 10,39,323, and the number of new claims received this year was 4,54,944. Thus, the total number of pending claims 14,94,267, out of which only 4,48,104 cases were settled, which was only 2 per cent of the total cases, therefore, it is estimated that it takes an average of four years to decide on a claim, he said.Jai said that in view of the inordinate delay in adjudication of motor accident claims, he has filed an interim application under WRI Petition (Civil) in the Supreme Court, seeking interim payment taking into account the delay in adjudication and payment of compensation in road accidents. Has been demanded. A scheme should be made by the Central Government under Section 164A of the Motor Vehicles Act so that the victims can get relief.

He said, “It has been suggested that as per no-fault liability under Section 164 of the MV Act, this amount should be at least Rs 5,00,000 for fatal cases and Rs 2,50,000 for injury cases."
