Mumbai: The Bombay High Court has directed the Mira Bhayandar Municipal Corporation (MBMC) to consider a fresh petition seeking permission for slaughter of animals during the Bakrid festival.

The court on Friday directed the corporation to reach a decision by noon on June 16.

The animal husbandry department of MBMC on June 10 canceled the temporary permission granted for slaughter of sacrificial animals during the festival.

The civic body canceled its June 5 order allowing the slaughter after considering the local police's contention that it could create law and order problems in the area.

Subsequently, petitioner Rizwan Khan approached the High Court seeking a stay on the civic body's decision to cancel the slaughter permit.

A division bench of Justice Shyam Chandak and Justice Revati Dere said that simple law and order problem cannot be a ground to cancel the permission which was given by the corporation on June 5.

"However, during the course of argument, we noted that the permission was not granted in strict accordance with certain Acts/Rules and particularly Section 6 of the Maharashtra Animal Preservation Act, 1976 and Rules, 1978," the court said.

Considering the urgency of the matter, the bench directed the petitioner to file a fresh application before the civic body seeking permission to slaughter buffaloes at a specified place.

It added, “If any such application is made, keeping in view the urgency, the concerned competent authority may expeditiously consider the application/permission for slaughter of buffaloes and in any case not later than June 16, 2024.” A decision has to be taken first.”

The bench directed MBMC to consider all acts/rules related to animal slaughter, including the provisions of the Maharashtra Animal Protection Act, 1976.

The court said that the decision has to be taken by noon on June 16 and the petitioner will have to inform it before 2 pm on the same day.
