The court said that the arrest of the accused was found illegal due to not giving proper information before the arrest.

Metropolitan Magistrate Akanksha Garg granted bail to Arun Kumar Bereddy on a personal bond of Rs 50,000. The court has also imposed conditions while granting bail.

The court rejected the application of the Special Cell of Delhi Police seeking three-day remand. The court said that although notice was given to the accused, he was not given sufficient time before his arrest on June 18.

The court said that the notice was given at 8:30 pm. The magistrate said, “I have perused the notice under section 41A of CrPC given by the IO, according to which the accused was to appear before the IO at 09:30 pm on the same day i.e. 18.06.2024.Thus, the notice u/s 41A CrPC was a mere formality and has not been complied with in letter and spirit."

The court said that the accused should be given adequate time to join the investigation, however, he was arrested by the IO at 10:30 pm.

The court said, this is not a case where the accused has failed to join the investigation.

"Therefore, I dismiss the application seeking PC remand of the accused. The arrest of the accused is found to be illegal as no proper notice has been given under section 41A of CrPC," the court said in the order passed on June 19.,
