Chief Justice K. A division bench led by Vinod Chandran struck down the amendments passed by the Bihar Assembly in 2023, saying they violated the equality clause under Articles 14, 15 and 16 of the Constitution.

The quota was increased after the Bihar government conducted a caste survey in the state. A notification issued in November 2023 sought to amend the existing reservation laws.

Challenging the decision of Nitish government, petitioner Gaurav Kumar had filed a petition in Patna High Court. The petitioner argued that according to the decision of the Supreme Court, reservation cannot be increased by more than 50 percent.

With the decision of Nitish government, the total quota in the state will be 75 percent, which includes 20 percent for SC, 2 percent for ST, 25 percent for Extremely Backward Class, 18 percent for Other Backward Classes. OBC) and 10 percent for economically backward classes.

Last year, the Punjab and Haryana High Court had also struck down a Haryana government law that sought to provide 75 percent reservation in Haryana-based industries for residents of the state.
