The court appointed lawyer Ankit Jain as amicus curiae and said the condition that a patient will be entitled to assistance only once for kidney transplant treatment is unfair.

Suresh Kumar Raghav sought financial assistance of around Rs 9 lakh under the umbrella scheme for kidney transplant for the second time due to chronic kidney disease.

The court said that he had earlier received assistance of about Rs 6 lakh under RAN for a failed transplant in April 2023 and he was informed that under the scheme, such assistance was given only once and he did not fulfill the eligibility criteria. Didn't do it.

"Issue notice to Government of India, AIIMS and Suresh Kumar Raghav," the bench comprising Justice Manmeet PS Arora said.

"Under the new umbrella scheme of RAN, the (monthly) income limit for benefit is Rs 1571 for rural areas and Rs 1605 for urban areas. The annual income of the applicant is Rs 96,000. The court prima facie holds that The threshold limit is extremely low,” the court said.
