Mumbai: The Bombay High Court on Wednesday directed the Maharashtra State Backward Classes Commission (MSBCC) to file its affidavit in response to petitions challenging the reservation given to the Maratha community.

A full bench of Chief Justice DK Upadhyay and Justices Girish Kulkarni and Firdosh Pooniwala had last week issued notice to the commission, which is headed by retired high court judge Sunil Shukre.

On the basis of the report of the commission, the Maharashtra government had given reservation to the Maratha community.

Attorney General R Venkataramani and lawyer Saket Mone appeared for the commission and sought time to file the affidavit.

The court gave the commission time till July 26 to file its affidavit and fixed the next hearing on the petitions on August 5.

The court had started the final hearing on the petitions earlier this month.

Last week, a petitioner had sought to make the Commission a respondent in the case as the Commission's report was also challenged in some of the petitions.

The Maharashtra government in February this year had given 10 per cent reservation to the Maratha community under the Socially and Educationally Backward Class (SEBC) category in government jobs and education.

Before the government's decision, the commission had submitted a report on its survey on the social, economic and educational backwardness of the Maratha community. Nearly 2.5 crore families were covered in this massive exercise.
