A vacation division bench of Justice Kaushik Chanda and Justice Apurba Sinha Ray made the remarks while hearing a public interest litigation (PIL) on the issue.

In the PIL filed by an organization named 'Rashtravadi Anjivi', it has been alleged that after the trend of Lok Sabha elections became clear in the state, incidents of post-poll violence started coming to light from the evening of June 4. The petitioner also alleged that in most of the cases, the state police is refusing to accept complaints from victims of post-poll violence.

After a detailed hearing in the matter, the vacation bench said that the Central and State Governments have equal responsibility in preventing such incidents of post-poll violence and both should work in close coordination to prevent such incidents.

It was also observed that if the State Police is unable to bring the situation under control in such cases of post-poll violence, the Central Armed Police Forces (CAPFs) will have the authority to take action.

The vacation bench also directed the state Director General of Police (DGP) to make arrangements so that victims can lodge their complaints through email in his office. As per the direction of the court, the DGP office should forward those complaints to the concerned police station and also ensure that they take action on them.

The DGP office was also directed to submit an affidavit on the number of FIRs lodged based on complaints of post-poll violence and publish these data on the state police website.
