The state minister of Urban and Territorial Planning, J.P. Dalal told the media that permission for four-storey stilt construction will be granted without conditions for residential plots in colonies and sectors where the layout plan is approved with four housing units per plot.

Additionally, in the already licensed Deen Dayal Upadhyay Jan Awas Yojana colonies, where the service plan for four housing units per plot is approved or revised, permission will also be granted for stilt and four-storey constructions.

Dalal said that in the colonies and sectors where the layout plan with three housing units per plot is approved, construction on stilts plus four floors will be allowed with certain conditions for residential plots that have access from a road of 10 meters or more.

In such colonies, if a person wishes to construct stilts plus four stories, submission of a mutual consent agreement is required with all owners of adjoining plots, except those who have already obtained approval for stilts plus four stories or a lateral setback of 1.8 m (on all floors). ) being maintained from adjacent plots.

However, the government has provided that if the owners of adjacent plots do not give their consent for construction on stilts plus four stories, they themselves will not be eligible for construction on stilts plus four stories in the future.

Dalal clarified that if a plot already has permission for three floors and a basement and now construction on stilts plus four floors is allowed, construction of basement and loading on the common wall will not be allowed.

However, in such cases, construction of basements and loading on the common wall will be allowed with the mutual consent of the owners of neighboring plots.

Furthermore, if the entire row of residential plots is constructed at once for building plan approval and construction, permission to construct the common wall will be granted.

Dalal said plot owners who meet the conditions of a 1.8-metre side setback or with the consent of neighbors can build stilts plus four storeys or apply for a refund of Purchasable Development Rights (PDR).

If a plot owner does not wish to build a stilt plus four storeys and opts for a lower PDR benefit, he is entitled to a refund with eight per cent interest from the date of refund application. This refund request can be made within 60 days from the date the refund order is issued.

Similarly, if the land is not eligible for three or four storey construction, the successful bidder is entitled to recover the entire auction amount with eight per cent interest from the date of refund claim. This request must also be made within 60 days of the issuance of the refund order.
