New Delhi [India], Delhi's Rouse Avenue Court recently asked the All India Institute of Medical Sciences (AIIMS) to constitute a medical board and investigate Nitin Johri, accused in the Bhushan Steel Limited (BSL) money laundering case. Johri is seeking regular and interim bail on medical grounds.

Special CBI judge Jagdish Kumar directed the AIIMS director to constitute a medical board at the earliest to examine accused Nitin Johri and file a report.

The jewelers are seeking relief on medical grounds.

The Enforcement Directorate (ED) opposed the bail plea and said that considering the allegations, the jeweler's illness was not so serious that it could not be treated during the applicant's custody.Against the applicant.

On the other hand, the accused's lawyer said that the accused can be granted bail on medical grounds only on the basis of medical documents. He also relied on previous decisions of the High Court.

Opposing the plea, ED counsel said that opinion can be taken from the medical board regarding the medical condition of the applicant.

After hearing the rival arguments, the court deemed it appropriate to constitute a medical board to properly evaluate the medical condition of the applicant/accused.

“Accordingly, the Director, AIIMS is requested to constitute a Medical Board at the earliest.The IO is directed to appear before the Director, AIIMS with a copy of this order and necessary medical documents of the applicant/accused Nitin Johri attached with the bail. Application for constitution of the said Board,” the court said in the order passed on June 6.

It further ordered that once the Board is constituted, the investigating officer will coordinate and inform the jail authority about the date of appearance of the applicant/accused before the Board.

The applicant appears before the Medical Board on the date fixed by the Board for examination of the applicant.

The court directed, “The Board shall endeavor to investigate the applicant/accused at the earliest and submit a report on or before 02.07.2024.,

The court has directed the jail superintendent to provide him the best possible medical treatment from the government hospital.

The court said, "If the need arises that the applicant/accused needs to get treatment in a particular hospital, then on the advice of the doctor of the government hospital, the applicant/accused can get the treatment in the suggested private hospital. The cost of treatment in the private hospital will be borne by the applicant/accused." shall be borne by the accused."

Accused Nitin Johri is the former Chief Financial Officer (CFO) of BSL. He was arrested by SFIO in 2019.

ED had also registered a case of money laundering. He along with others pleaded guilty in January 2024.
